YUCATAN YACHTS RESERVATION POLICIES

This policy confirms that the specified terms are automatically activated and also made available on our website. Your Booking Confirmation is affiliated with Yucatan Yachts. By booking a tour with us, you acknowledge that you have reviewed and agreed to these booking conditions. The individual chartering, hereafter referred to as the “Charterer,” assumes responsibility for the entire charter cost, encompassing insurance premiums, cancellation, or modification fees. A contractual agreement is established upon receipt of your invoice from Yucatan Yachts.

PAYMENT TERMS

To secure your charter reservation, a 30% deposit is required. The remaining balance must be settled upon arrival at the marina prior to boarding the boat.
• A valid credit card and unexpired identification must be provided as a guarantee at the time of booking.
• Marina fees and taxes will be collected in cash before boarding.
• We prefer cash payments and accept both American Dollars and Mexican Pesos. However, if you choose to pay with a VISA or Mastercard, a 5% surcharge will apply.
• The designated representative of the group must present an official identification with a signature and photo to verify their identity. Yucatan Yachts will not provide the service without proper official identification.

PRICES AND EXCHANGE RATE

• The prices listed are in American Dollars, including the fee applied to credit card transactions. If your credit card is not in American Dollars, the exchange rate will be determined and applied by your bank.

ACCIDENTAL, DAMAGE, DEATH & INJURY

Yucatan Yachts will not be held liable for any claims, damages, or injuries, including property damage, personal injury, or death, resulting directly or indirectly from the use or consumption of alcohol or drugs. This holds true even if such incidents occur partially due to negligence on the part of Yucatan Yachts.

This does not in any manner reduce or diminish Yucatan Yachts’ accountability for its negligence in cases where property damage, personal injury, or death does not stem directly or indirectly from the use or consumption of alcohol or drugs.

SWIMMING, SKIN DIVING AND JETSKI

Yucatan Yachts, the yacht owner, and the insurance underwriters will not be held responsible for accidents, injuries, or fatalities resulting from activities such as swimming, windsurfing, jet skiing, kayaking, or the use of snorkels, masks, or related equipment like scuba gear and sailboards.

EQUIPMENT AND YACHT INSURANCE COVER

Our insurance policy offers comprehensive coverage for both equipment and yachts, ensuring protection for your skipper and crew. However, the Company cannot be held accountable for any losses resulting from the insurers’ refusal to provide cover. This includes instances where incorrect information, such as previous sailing experience, is provided upon request, or due to negligence, deliberate default, or willful misconduct on your part. If damage or loss to yachts and equipment occurs due to failure to comply with the Company’s instructions, you will be liable for the full cost of repair or replacement, along with any associated expenses.

Adults are responsible for minors under their care at all times. The Company commits to insuring the yacht against public liability and marine public liability to the extent deemed appropriate at its sole discretion.

Please note that this insurance policy does not cover loss of life (except in cases of negligence by the Company) or damage to or loss of property of any person on board, for which you must arrange insurance before the charter. The Company can provide guidance on obtaining such insurance upon request.

TERMINATION OF VACATION & INDEMNITY:

The Charterer acknowledges responsibility for their own conduct and that of their crew. Yucatan Yachts retains the right, at our sole discretion, to immediately terminate the vacation arrangements of any Charterer who fails to adhere to our instructions or orders, or whose behavior or competency, in our opinion, may pose distress, danger, annoyance, or damage to our crew, other customers, staff, third parties, or property. In the event of such termination, Yucatan Yachts bears no further responsibility for the Charterer’s vacation and shall not be liable for any incurred costs.

CANCELLATIONS TERMS

Decisions regarding cancellations due to weather are solely at the discretion of Yucatan Yachts and will be communicated to the Charterer via email or phone prior to the tour commencement. In the event of weather-related cancellation where rescheduling is not feasible, Yucatan Yachts will provide a full refund of any deposit made by the Charterer.

Yucatan Yachts maintains the right to cancel a tour, with notification to the Charterer via email or phone before the tour begins. In such cases, Yucatan Yachts will issue a full refund of any deposit paid by the Charterer.

Any alterations in dates, destination, or yacht type initiated by the Charterer are considered cancellations. Failure by the Charterer to meet scheduled payment deadlines may result in Yucatan Yachts canceling the charter, with all deposits and fees paid to date retained by Yucatan Yachts.
The following cancellation policies are applicable for clients:

• Cancellations made more than 30 days prior to the experience will incur a 20% cancellation fee.
• Cancellations made 15 to 29 days prior to the experience will incur a 30% cancellation fee.
• Cancellations made 8 to 14 days prior to the experience will incur a 50% cancellation fee.
• Cancellations made fewer than 14 days prior to the experience are non-refundable.
• Cancellations made within 24 hours prior to the experience will result in a full charge.
• No-shows: If the client fails to arrive at the marina at the scheduled date and time of the activity, a full charge will be applied.

The client authorizes Yucatan Yachts to utilize the booking deposit as the cancellation fee and/or to charge this fee directly to the registered credit card.

In the event of lateness beyond the specified check-in and boarding time, any missed time cannot be compensated or refunded. The tour operates on a fixed schedule with a designated start and end time.

REASONS FOR CANCELLATION BY YUCATAN YACHTS

Yucatan Yachts reserves the right to cancel the trip only under one circumstance:
• In the event of a breakdown or if the boat requires maintenance before the trip. In such cases, the company will endeavor to reschedule the date or provide an alternative vessel.
• If neither option is feasible, a full refund of 100% of the experience cost will be issued.

Reasons that do not justify cancellation or refund include:
• Inclement weather conditions, such as rain or cloudiness at the guest’s location or the marina.
• Unfavorable weather conditions, including rain, cloud cover, extreme heat or cold, rough seas, windy conditions, or the inability to engage in snorkeling activities.
• Closure of the ports in Cancun, Playa del Carmen, or Puerto Aventuras (in such cases, guests can still enjoy their selected experience within a sheltered area designated by the captain).
• Seasickness or dizziness experienced by any individual during the tour.
• Early termination of the trip due to illness or at the client’s request.
• Depletion of drinks or food supplies due to unusually high consumption.
• Client negligence resulting in any type of accident.
• If the client experiences any type of accident due to their own negligence.
• If there is any dispute regarding the service provided during the experience.
• If the client disagrees with the safety regulations of the boat during the experience.
• If the client arrives after the time specified on the Booking Confirmation.

Kindly review your invoice details thoroughly to ensure that they align accurately with our prior discussion, encompassing all information, charges, and inclusions. If any discrepancies arise, please notify us promptly so we can address them accordingly!
